{"id":1119,"date":"2025-05-24T08:45:21","date_gmt":"2025-05-24T08:45:21","guid":{"rendered":"https:\/\/youdigital.pk\/en\/?p=1119"},"modified":"2025-05-24T08:45:21","modified_gmt":"2025-05-24T08:45:21","slug":"scotus-puts-leash-on-doge-docs-foia-fight-heats-up","status":"publish","type":"post","link":"https:\/\/youdigital.pk\/en\/2025\/05\/24\/scotus-puts-leash-on-doge-docs-foia-fight-heats-up","title":{"rendered":"SCOTUS Puts Leash on DOGE Docs \u2014 FOIA Fight Heats Up!"},"content":{"rendered":"<p><strong>WASHINGTON :The U.S. Supreme Court has temporarily halted efforts to compel the Trump administration to release thousands of documents related to the Department of Government Efficiency (DOGE), a controversial entity created during Donald Trump&#8217;s presidency.<\/strong><\/p>\n<p>The order, issued by Chief Justice John Roberts, pauses lower court rulings that had required the release of internal documents and the deposition of DOGE\u2019s administrator, Amy Gleason.<\/p>\n<h2 data-start=\"606\" data-end=\"631\">Background of the Case<\/h2>\n<p data-start=\"633\" data-end=\"969\">The legal dispute began when watchdog group Citizens for Responsibility and Ethics in Washington (CREW) filed a Freedom of Information Act (FOIA) request in January 2025, shortly after Trump resumed office.<\/p>\n<p data-start=\"633\" data-end=\"969\">The request sought records from DOGE, which has overseen major federal spending cuts, grant eliminations, and government layoffs.<\/p>\n<p data-start=\"971\" data-end=\"1304\">The Trump administration argues that DOGE is merely a presidential advisory body and not a federal agency, and thus not subject to FOIA. Critics, however, point out that DOGE effectively replaced the U.S. Digital Service, now renamed the U.S. DOGE Service (USDS), and functions in a capacity that mirrors that of an executive agency.<\/p>\n<hr data-start=\"1306\" data-end=\"1309\" \/>\n<h2 data-start=\"1311\" data-end=\"1332\">Lower Court Ruling<\/h2>\n<p data-start=\"1334\" data-end=\"1784\">In March, U.S. District Court Judge Christopher Cooper ruled that DOGE is \u201clikely\u201d subject to FOIA and that public interest warranted an expedited release of the documents.<\/p>\n<p data-start=\"1334\" data-end=\"1784\">Cooper ordered DOGE to begin turning over documents as soon as possible and to preserve all potentially relevant records.<\/p>\n<p data-start=\"1334\" data-end=\"1784\">According to filings, DOGE has about 58,000 documents, while the Office of Management and Budget (OMB) holds over 100,000 that may be relevant to the case.<\/p>\n<hr data-start=\"1786\" data-end=\"1789\" \/>\n<h2 data-start=\"1791\" data-end=\"1819\">Supreme Court Involvement<\/h2>\n<p data-start=\"1821\" data-end=\"2321\">The Supreme Court\u2019s administrative stay temporarily suspends Judge Cooper\u2019s orders, granting the Trump administration a pause while the high court decides whether to take up the case.<\/p>\n<p data-start=\"1821\" data-end=\"2321\">CREW has argued in court that the lower court\u2019s discovery order was narrowly tailored to assess whether DOGE operates as a government agency.<\/p>\n<p data-start=\"1821\" data-end=\"2321\">The group also emphasized that the Supreme Court rarely intervenes in ongoing discovery matters and that there is no justification for such extraordinary action in this case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>WASHINGTON :The U.S. Supreme Court has temporarily halted efforts to compel the Trump administration to release thousands of documents related to the Department of Government Efficiency (DOGE), a controversial entity created during Donald Trump&#8217;s presidency.
